Terms and Conditions
1.1 Your use of cryptobuy.ge is provided by ``Andromeda Crypto Galaxy'' LLC (hereinafter referred to as "cryptobuy" or "we").
LLC ``Andromeda Crypto Galaxy'', a limited liability company registered in Georgia;
2.3 These Terms apply to all visitors, users and other persons who register or otherwise access or use the Product (hereinafter referred to as "you", "your" or "users").
3 Compliance with Requirements
Before using this product, you represent, warrant and agree to the following terms:
3.1 You use our Product at your sole choice, discretion and risk;
3.2 Our product may be used in cases permitted by the laws of your jurisdiction (country of permanent residence);
3.3 You are responsible for paying any taxes or other legal obligations that may be due/arising from your use of our product;
3.4 You are over the age of 18 or of any other age permitted by law in your country's applicable jurisdiction, as our Product is not permitted to be used by persons under the age of 18;
3.5 You are a natural person, legal entity or other organization that has full legal capacity and authority to enter into this Agreement;
3.6 If you agree to this Agreement on behalf of a legal entity or other entity that you represent, you represent and warrant that you have all necessary rights and authority to enter into obligations on behalf of such legal entity;
3.7 You agree to pay the Fees for using our Product as determined by CryptoBuy and may change from time to time;
3.8 You acknowledge that there are risks associated with the Internet system, such as hardware failure, software and Internet connection malfunctions, etc. Also, any kind of malfunction/defect or attack on our website.
4 Using our product
4.1 The product allows registered users
4.1.1. buy or sell crypto-assets in exchange for other crypto-assets or standard currency;
4.1.2. Buy crypto miners or various mining related equipment
4.3 Cryptobuy may, at its sole discretion, change or update the functionality of the Product, in whole or in part, at any time.
4.4 You must not transfer your rights to use the Product or otherwise dispose of any part of your rights under these Terms.
4.5 These Terms do not grant you the right or permission to copy, distribute, modify or otherwise use the Product interface, except in exceptional cases.
5 Use of Accounts
5.1 Your Cryptobuy account enables you to use the Product and any other features that we develop and operate from time to time and at our discretion.
5.2 We may have different types of accounts for different types of users.
5.2.1 You may not use another user's account without appropriate permission. When creating your account, you must provide accurate and complete information and you must keep this information updated.
5.3 You are responsible for controlling and maintaining appropriate security of your authentication information, passwords, private keys, personal identification numbers (PINs) and any other means you use to access the Product.
5.4 You must maintain the confidentiality of your account information and not allow any third party to access or use the Product on your behalf until we provide you with appropriate confirmation.
5.5 If you believe that the security of your account has been breached, you must notify us in writing at email@example.com
5.6 You are responsible and Cryptobuy.ge does not fulfill any obligations for all the operations that will be carried out on your Cryptobuy.ge account.
5.7 Cryptobuy allows you to generate wallet addresses that you can use to send or receive crypto assets.
5.8 You are solely responsible for the security of your wallet.
5.10 You acknowledge and agree that it may take up to 48 hours from the time such request is made to process a standard currency (USD/GEL) deposit / withdrawal request. Standard currency (Dollar/Lari) deposit/withdrawal operations may be delayed due to the following reasons: our non-working hours, non-working days of partner/intermediary banks and your servicing bank and the time provided by their processes. However, the execution of a deposit/withdrawal request may be delayed for any technical reason. Cryptobuy may be forced to cancel or return an already executed deposit / withdrawal operation at the request of financial institutions, including but not limited to banks participating in this operation. In such cases, you must cooperate with Cryptobuy to investigate the reasons for such request.
6 Suspension, Termination and Cancellation of the Agreement
6.1 We may, without prior notice, stop using the Product, change the Product; stop making the Product or certain features thereof available to you or to users generally; or impose usage or transaction limits on product consumption.
6.2.1 We are required to do so by a court order or mandatory order of a state agency;
6.2.2 We reasonably suspect that you are using the Product for a prohibited activity;
6.2.3 Your use of the Account is subject to judicial review, investigation or governmental proceedings and/or we believe that your use of the Product poses a risk of non-compliance with legal or regulatory legislation.
7 Compensation for damages
7.1 You agree to defend and indemnify Cryptobuy and its subsidiaries, representatives and other affiliates, as well as their employees, contractors, agents, assigns and directors, against any and all claims, damages, liabilities, expenses (their including, but not limited to, attorney's fees), resulting from:
7.1.2 Your violation of the right(s) of any third party, including but not limited to the right(s) relating to personal data or intellectual property;
7.1.3 As a result of violating any law, rule or regulation;
7.1.4 By your deliberate action.
8 Absence of warranty
8.1 The product will be delivered on an "as is" basis. All risk associated with the use of the product rests with you.
8.2 Cryptobuy and its affiliates do not warrant that the Product Content will be accurate, reliable or correct; that the product will meet your requirements; THAT THE PRODUCT WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, WILL BE UNINTERRUPTED OR SECURE; that all defects or errors will be corrected; or that the product does not contain viruses or other harmful components. Any technical or mechanical fault/error shall be treated as an unforeseen circumstance and in such circumstances Cryptobuy shall be entitled to cancel/refund the transactions made during the fault. In the event that you received an excess amount/cryptocurrency as a result of a defect/error, Cryptobuy is entitled to deduct from you the amount/cryptocurrency obtained as a result of the defect/error.
8.3 Cryptobuy does not warrant, endorse or accept responsibility for any product or service advertised or offered by third parties through the Product or any linked website or service.
10 Return Policy
10.1 Our company allows its customers to take advantage of refunds or product replacements. Possibly if the transaction is made in standard currency (GEL, USD) using SWIFT or IBAN (bank transfer) and if the processing of such transaction has not been completed and the transfer does not have a "completed" status. Transactions carried out with a bank card, as well as transactions related to the exchange of cryptocurrencies, are not subject to return. It is not possible to refund more than the amount originally paid. Customers will be notified of Cryptobuy's refund decision by email to the email address(es) registered by the customer in Cryptobuy's system.
10.2 In order to request a refund, the customer must contact Cryptobuy by sending an email to firstname.lastname@example.org, indicating the refund request and the corresponding transaction number. For a faster response to a refund request, it is recommended that the customer contact the customer support team to cancel the transaction and request a refund. After receiving the refund request, the customer will be notified of the decision.
10.2.1 If the user purchased an item on Cryptobuy.ge and it was found to be defective, he can request a return by writing to email@example.com. The email must include photos of the item, the transaction receipt, and photo/video/written material indicating the problem.
10.3 Please note that it may take an average of 2 business days from the time a customer requests a refund or exchange to process such a request. All refund or exchange requests are thoroughly checked and verified by Cryptobuyl. In case of a positive decision by Cryptobuy to refund or exchange the item, the amount will be returned to the client using the same method and to the same bank details from which the client made the initial transaction on Cryptobuy. Refunds are made by SWIFT (bank transfer) method, on bank working days. Please note that refunds to the customer's bank account may take up to five business days, depending on the bank's internal policies and/or procedures, over which Cryptobuy has no influence. And it may take 30 working days to replace the item.
10.4 During the process of processing the request for a refund, Cryptobuy may request additional documents, such as proof of identity or payment order, or other proof of payment. If the documents requested by Cryptobuy from the client are not submitted within 2 working days after sending the request, or Cryptobuy doubts the authenticity of the documents provided, the processing time of the refund request will be extended and a decision will be made on further actions by Cryptobuy.
10.5 Customers must provide accurate and correct information in connection with the initial transaction. Cryptobuy is not responsible for the outcome of any transaction made due to the error of the customer or the provision of incorrect or misleading information.
10.6 Any costs associated with refunds will be borne by the customer. The costs associated with the return will be deducted from the refund amount received by the customer.
